- Determining the possible sources of liability: We will begin by determining what liability issues may arise for you, such as: professional malpractice, general torts (car accidents, etc), contract claims, business relationships such as officer and director liability, creditors, lawsuits, environmental liability, divorce, forced heirships (i.e., Right of Election), political threats, and economic risks.
- Determining your insurance adequacy: The next step is to see how effective your insurance is at protecting you from possible liability, including life insurance, homeowners insurance, auto insurance, disability insurance, business risk insurance, director and officers insurance, and umbrella insurance.
- Maximizing exemption allowances: We will make sure that you are taking all exemptions available by looking at your retirement plan contributions, joint ownership and community property.
- Reviewing estate plans and the nature of your asset holdings with a view towards creditor protection: Whether you expect inheritances and whether your wills and trusts provide for outright distribution to your beneficiary are important factors in asset protection. We will also look at your business activities, including what business entity you use and your role in that business (general partner, limited liability partner, etc.). We will then consider whether it is possible to reorganize your holdings to separate the assets with potential liability from your other assets.
